Terms of order

What these terms cover

They apply when you order a cake from Sunset Cakes. Placing an order — by WhatsApp, by phone, or by sending the order form through — means you accept them. They do not take away any right you have under Nigerian consumer law.

This site quotes no prices

Nothing on this website is a price, an estimate or an offer, and no page here is a contract. Ingredient costs in Nigeria move quickly enough that a published figure would be misleading within weeks, so every cake is priced individually when you get in touch.

You will never be asked for anything you have not agreed to in writing first. What we confirm in the WhatsApp thread is what stands.

How an order is confirmed

Sending the order form through, or messaging us, is an enquiry. It is not an order and it does not hold your date. An order exists once we have agreed the details with you in writing and you have confirmed you want to go ahead.

Until then the date stays open to anyone else, so if your date is tight, do not wait.

Notice we need

At least 7 days for most cakes, and three to four weeks for wedding cakes and anything sculpted. If your date is sooner, ask anyway — we tell you straight away whether the diary allows it rather than leaving you guessing.

Changes and cancellations

• Changes are fine up to five days before your date, as long as the ingredients are not already bought. A change to the size or the design may change what we agreed, and we tell you before we act on it.
• Cancelling — tell us as early as you can. The date has been held for you and someone else may want it. Anything already agreed between us is settled directly with you.

If something serious happens, tell us. We would rather find a way through than hold you to a line in a document.

Handmade means not identical

Every cake is made by hand from scratch. Yours will match what we agreed in size, flavour and design, but colours and finish will differ slightly from a photograph — sugar behaves differently in different weather, and screens show colour differently. That variation is not a fault.

Where you send us a picture, we make our version of that design. We say so honestly beforehand if we do not think it is achievable.

Allergens and food safety

Every cake contains gluten, dairy and egg as standard, and we handle nuts and soy in the same kitchen. We cannot guarantee any cake is free of an allergen, because we cannot rule out cross-contact.

If anyone eating the cake has an allergy, you must tell us before ordering. We will be honest about whether we can work around it, and we would rather turn an order down than take a risk with someone's health.

Delivery and collection

We deliver anywhere in Lagos, and you are welcome to collect from us inAjah instead. We agree which of the two, and everything that goes with it, before the day.

Someone must be at the address to receive the cake, and the phone number you give us must be reachable on the day. Once a cake has been handed over — to you, or to someone collecting for you — it is in your care.

After the cake reaches you

Keep it cool and out of direct sun and eat it within three days. Refrigerate only if it has fresh cream or fresh fruit. We cannot be responsible for a cake that has been transported, stored or assembled by someone else after it left us.

If something is wrong

Tell us on the day, with photographs, before the cake is cut or eaten. Where we have genuinely got it wrong we put it right. We cannot assess a complaint about a cake that has already been eaten.

Photographs of your cake

We photograph what we make and may show it on this site or on Instagram. If your cake carries a name, a message or anything personal and you would rather it stayed private, say so and we will not publish it.

Governing law

These terms are governed by the laws of the Federal Republic of Nigeria. You are contracting with The Sunset Metropolitan Confectioneries Ltd, trading asSunset Cakes, registered with the Corporate Affairs Commission, Nigeria asRC 1541457. We trade from Ajah,Lagos.
